Welcome to Tropical Fish Co. By accessing or using our website and services, you agree to these Terms of Service. If you do not agree, please do not use the site.
You must be at least 18 years old and able to enter a binding contract. You agree to provide accurate information and to keep your account secure.
You are responsible for all activity that occurs under your account. Notify us right away if you suspect unauthorized use.
Livestock availability changes often. Photos show typical form and color, individual fish vary in size, color, sex, and pattern. Sizes are approximate. Quantities may be limited. If an item becomes unavailable, we will contact you to choose a replacement or cancel that item.
Prices are listed at checkout and are subject to change without notice. You authorize us to charge your selected payment method for the full order amount, including taxes and shipping. Orders are not confirmed until you receive an order confirmation email.
You are responsible for any applicable taxes. Discount codes and promotions apply only as stated and may be changed or ended at any time.
We currently ship to the contiguous United States only. We ship live fish early in the week, usually Monday and Tuesday, to protect animal welfare and reduce delays. We may hold an order for weather or routing concerns. Delivery dates are estimates. Carrier scans and time stamps will be used to verify delivery and first delivery attempts.
Risk of loss transfers to you at the time of delivery to your address or at the first delivery attempt if you miss the delivery. For pickup orders, risk transfers at pickup.
We guarantee live arrival of fish if the conditions below are met.
If these conditions are met and a fish arrives dead, we will refund the fish price and the portion of shipping attributable to that fish, either to the original payment method or as store credit. If your order included multiple fish, shipping will be refunded pro rata for the lost item.
Please acclimate fish properly and follow the acclimation instructions provided on our website. Do not release bag water into your tank. We are not responsible for losses that occur after successful acclimation or due to incompatible tank mates or water conditions.
The guarantee does not cover delays or damage caused by incorrect addresses, missed delivery attempts, refusal of delivery, extreme weather, carrier disruptions, acts of nature, or fish that die after the one hour reporting window.
Orders for live animals cannot be returned. We cannot guarantee cancellations or substitutions once an order is placed, since orders may move into preparation quickly to protect animal welfare. Once packed, the order cannot be changed or canceled.
We reserve the right to refuse shipment when we believe weather, routing, or customer conditions would put the animals at risk. We may substitute heat packs or cold packs at our discretion.
You agree not to misuse the site, including scraping, reverse engineering, interfering with security, or using the site for unlawful purposes.
If you submit reviews, photos, or other content, you grant Tropical Fish Co. a nonexclusive, royalty free license to use, reproduce, and display that content on the site and our social channels. You promise you own or control the rights to any content you submit.
All site content, logos, photos, and text are owned by Tropical Fish Co. or our licensors and are protected by law. You may not use our marks without written permission.
We may link to third party sites and services, including Aquarium Co-Op for supplies. Those sites are operated by third parties, their content and policies apply, and purchases made there are subject to their terms.
Your use of the site is also governed by our Privacy Policy. Please review it to understand how we collect and use information.
Except for the Live Arrival Guarantee described above, the site and products are provided as is. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and noninfringement.
To the fullest extent permitted by law, Tropical Fish Co. will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, even if we have been advised of the possibility. Our total liability for any claim related to your order or use of the site will not exceed the amount you paid for the order at issue.
You agree to indemnify and hold Tropical Fish Co., our owners, employees, and partners harmless from claims, damages, losses, and expenses that arise from your use of the site, your violation of these terms, or your violation of any law or third party rights.
These terms are governed by the laws of the State of Iowa, without regard to conflict of law rules. Any dispute will be resolved in the state or federal courts located in Woodbury County, Iowa, and you consent to that venue. You and Tropical Fish Co. agree to bring claims only in your or our individual capacity.
We may update these terms at any time by posting a new version on the site. The new version is effective when posted. Your continued use of the site means you accept the updated terms.
